Agreement to Terms

By accessing and using Vibe to Viable services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Services Description

Vibe to Viable provides fixed-price digital product development packages specifically focused on transforming AI-generated prototypes into market-ready applications. Our service packages include:

• The Launchpad (Marketing Site): $3,500 | 1 Week
  High-converting landing page development, SEO & analytics setup, and lead capture integration.
• The MVP Foundation (SaaS/Portal): $7,000 | 2 Weeks
  Secure user login & signup, database setup & data strategy, and full UI/UX polish.
• The Digital Storefront (E-Commerce): $12,250 | 1 Month
  Stripe/payment integration, order management system, and trust-building receipt & email flows.
• The App Platform (Cross Platform): $18,500 | 2 Months
  iOS & Android native app development, app store submission & compliance, and mobile-optimized gestures.
• Multiple Package Discount: 10% lifetime discount when purchasing multiple packages

Ongoing Support Add-Ons

• Peace of Mind Infrastructure: $299/month
  Continuous monitoring, security updates, performance optimization, and priority technical support.
• Growth Intelligence: $499/month
  Monthly analytics review, feature usage analysis, performance insights, and strategic roadmap recommendations.

Payment Terms

Payment terms are as follows:

• Fixed-Price Packages: All packages are priced as fixed-price projects with the cost and timeline clearly specified (The Launchpad: $3,500, The MVP Foundation: $7,000, The Digital Storefront: $12,250, The App Platform: $18,500)
• Multiple Package Discount: 10% lifetime discount automatically applied when purchasing multiple packages in a single transaction
• Support Add-Ons: Monthly recurring subscriptions for Peace of Mind Infrastructure ($299/month) and Growth Intelligence ($499/month), billed monthly
• Payment is processed through our secure checkout system at the time of purchase
• Refunds are handled on a case-by-case basis within the first 14 days of project start, based on work completed and project circumstances
• Late payments for monthly support services may result in service suspension
• All prices are in USD and exclude applicable taxes
• Package prices are one-time fees; support add-ons are recurring monthly subscriptions

Project Scope and Deliverables

Project scope is defined by your selected package(s) and the specific features included in each package:

• Each package includes a predefined set of deliverables and timelines as specified in the package description
• Package scope is fixed and includes all features listed in the package description for the specified price
• Changes to scope must be requested in writing and approved by both parties
• Additional work beyond agreed package scope will be quoted separately and may require additional packages
• Change requests will be documented in a change order before implementation
• We reserve the right to decline scope changes that compromise project quality or timeline
• Monthly support add-ons include ongoing maintenance and optimization as specified in service descriptions

Client Responsibilities

To ensure project success, clients agree to:

• Provide timely feedback and approvals within agreed timeframes
• Supply necessary content, assets, and access credentials
• Participate in scheduled meetings, reviews, and initial consultation call
• Provide access to existing code repositories and design files
• Test deliverables thoroughly and report issues promptly
• Maintain confidentiality of our proprietary processes and methodologies

Intellectual Property

Upon full payment of all fees:

• You retain full ownership of your business concept, branding, and original content
• You receive full rights to all custom code and designs created specifically for your project
• We retain the right to showcase the work in our portfolio and case studies (with your permission)
• Third-party tools, frameworks, and libraries remain under their respective licenses
• We retain ownership of our proprietary methodologies, processes, and general knowledge

Warranties and Disclaimers

We provide our services with professional care and make the following warranties:

• Services will be performed in a professional manner consistent with industry standards
• We provide a 30-day bug fix warranty on delivered code for defects in our work
• We warrant that our work will not infringe on third-party intellectual property rights
• We do not guarantee specific business outcomes, user adoption, or revenue results
• Third-party service availability and performance are not under our control
• We disclaim all other warranties, express or implied

Limitation of Liability

Our liability is limited to the total amount paid for services under the applicable project. We are not liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, business opportunities, or revenue
• Issues arising from third-party services, hosting, or integrations
• Damages resulting from your use of the delivered product
• Delays caused by client feedback cycles or scope changes
• Market conditions or competitive factors affecting your business

Confidentiality

We maintain strict confidentiality regarding your project information:

• All project details, business information, and code are kept confidential
• We will not disclose your information to third parties without your consent
• Our team members sign confidentiality agreements
• Confidentiality obligations survive termination of our agreement

Termination

Either party may terminate the agreement with written notice. Upon termination:

• Client pays for all work completed to date based on project progress or pro-rated monthly support fees
• We deliver all completed work and transfer ownership of deliverables
• Monthly support subscriptions can be cancelled at any time with 30 days notice
• Both parties return or destroy confidential information
• Confidentiality and intellectual property obligations continue indefinitely

Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, or significant disruptions to internet infrastructure.

Governing Law

These terms are governed by the laws of New Hampshire, United States. Any disputes will be resolved through binding arbitration in New Hampshire, with the prevailing party entitled to reasonable attorney fees.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated to active clients. Continued use of our services constitutes acceptance of modified terms.

Vibe to Viable is an independent service provider and is not affiliated with, endorsed by, or connected to v0.dev, Lovable, or any other AI prototyping tools mentioned on this website. All trademarks, service marks, and company names are the property of their respective owners and are mentioned for descriptive purposes only.
